Purpose of Class Action Litigation for Unconstitutional Acts

The upcoming litigation against the Jurupa Unified School District is premised on violations of basic Due Process, failures to treat employees equally, and arbitrary discrimination against minority employees (race, religion, and other protected factors).  So far, there are several dozen employees who appear to have fallen victim to unconstitutional practices and it is anticipated that even more will come forward once the litigation is instituted.

 

The District is also alleged to have repeatedly violated the First Amendment rights of anyone who disagrees with the Superintendent or his personal supporters.  The allegedly illegal conduct of the District is causing severe economic harm to employees, has resulted in other injury to the employees, and is in abject violation of the Collective Bargaining Agreement which was entered into by the affected parties.

 

The violations of law have reached a constitutional dimension which threatens the basic trust of citizens in the District.  Indeed, the treatment of bus drivers within the District has risen to the level of laying the foundation for serious health & safety risks to disabled children and others.  When employees have attempted to correct safety issues, it is alleged that the District ignored or overrode such concerns in favor of budgetary, power, or other improper motives.

 

This litigation is being brought in the public interest and because of the horrific impact that the District has had on religious diversity in the workplace, the silencing of employees, and the impact on families within the District.
